Terms of Use

Last updated: August 2026

1. Introduction

These terms of use govern your access to and use of the The New Forest Co website at thenewforest.co (the "Website"), The New Forest Co Portal (the stockist and wholesale portal, the "Portal"), and any Making Tax Digital VAT software functionality made available through the Portal. By using any of these services, you agree to these terms.

These services are operated by The Burley Trading Co Ltd, registered in England and Wales (No. 17061537).

2. Use of the website

You are welcome to browse the Website for your own informational and trade enquiry purposes. You must not use the Website for any unlawful purpose or in any way that could damage, disable, or impair the Website or interfere with any other party's use of it.

Prohibited uses include (but are not limited to): scraping or automated data collection; attempting to gain unauthorised access to any part of the Website or its underlying systems; transmitting any unsolicited commercial communications; or reproducing, distributing, or republishing any content from the Website without our prior written permission.

We do not warrant that the Website will be available at all times or free from errors. We reserve the right to suspend, withdraw, or restrict access to any part of the Website at any time without notice.

3. The New Forest Co Portal

Access to the Portal is intended for authorised trade and wholesale customers only. By registering for or using the Portal, you confirm that you are acting in the course of a business, not as a consumer.

You are responsible for ensuring that all information you provide when registering or placing orders through the Portal is accurate and kept up to date. You must keep your login credentials confidential and must not share access with any third party.

We reserve the right to suspend or terminate Portal access where we reasonably believe the account is being used for improper or unauthorised purposes, or where any of these terms have been breached.

4. Making Tax Digital (HMRC MTD)

The Portal includes functionality that connects to HMRC's Making Tax Digital (MTD) service on behalf of your business. By authorising this connection, you permit The Burley Trading Co Ltd to access your HMRC MTD data for the purposes of facilitating VAT submissions and retrieving VAT obligation and liability information.

You and your business remain solely responsible for the accuracy, completeness, and timeliness of all tax data submitted to HMRC through the MTD service. The software provides a means of access to HMRC systems and does not constitute tax, accounting, or legal advice. You should seek independent professional advice if you are uncertain about your VAT obligations.

Compliance with HMRC MTD regulations, including the requirement to keep digital records and submit returns on time, is at all times the responsibility of your business. We accept no liability for penalties, surcharges, or other consequences arising from inaccurate or late submissions.

5. Intellectual property

All content on the Website and Portal, including but not limited to text, images, logos, product photography, and design elements, is owned by or licensed to The Burley Trading Co Ltd and is protected by copyright and other intellectual property laws. Stockists and trade customers may not reproduce, adapt, or distribute any such content without our prior written permission.

6. Limitation of liability

To the fullest extent permitted by applicable law, The Burley Trading Co Ltd shall not be liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of the Website, the Portal, or the MTD software functionality, including but not limited to loss of profits, loss of data, or business interruption.

Where liability cannot be excluded by law, our total liability to you in connection with any contract shall not exceed the value of that contract.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

7. Governing law

These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
